In his immigration case, Joe Giudice has just been shot down by a judge— he has been instructed to remain locked up while his case of deportation is playing out.
Earlier this month, Joe appealed to the court— where he appeared via video conference— for release pending his deportation appeal. The judge has now ruled, and it’s not for him.
He will stay locked up in the Clinton County Correctional Facility, the ICE detention facility he has been a resident of since his release from jail in March.
The Giudice family attorney, James Leonard Jr., says TMZ, “We’re totally devastated. This family has failed our justice system. We’re now at the mercy of the Third Circuit Court of Appeals. God ready to bring this guy back to his four daughters.” Joe’s homesick and tired of being held behind bars and feels that while he’s appealing, he should be released from ICE custody. Joe suggests the least that the judge can do is let him see his family, particularly if he still runs the risk of being deported quickly.
As we reported earlier… When a judge ordered his deportation to his indigenous Italy, Joe was instantly moved to ICE custody. This after serving a 41-month conspiracy sentence to commit fraud in wire and bankruptcy.
Joe appealed and lost that judgment. However, he appealed to a greater court again… And right now, that’s where we are. Joe wanted to be home with his family in New Jersey as he awaits the final decision of the judge.
Joe has the chance within the next 30 days to appeal this bond decision, but Leonard says it’s off the table, and they’re just holding tight to see how the deportation appeal plays out.
