Very few women Indian politicians have gone on to hold top most ministerial positions and even fewer have been able to win the hearts of public the way Mrs. Sushma Swaraj did. At ETV Bharat News Today, we will have a look at the reasons behind the popularity of Mrs. Swaraj. In this article, ETV Bharat Delhi will look into the life and times of one of the most admired ladies of India.

Sushma Swaraj, born February 14, 1952, who was a prominent BJP leader breathed her last on 6th December 2019 after suffering a cardiac arrest. The ex-Union minister, who passed away at the age of 67, had a great fan-following not just among the public but also had admirers cutting across party lines. From helping Indians stuck overseas to interacting with people on the social media platform, Twitter, she emerged as one of the most popular leaders during her term as the External Affairs Minister from 2014-2019.

Her term as the foreign minister will be remembered for many path-breaking steps such as ease of passport procurement procedure and enhanced engagement with the East. She was only the second woman to hold the foreign ministry after Indira Gandhi.

Education And Career

The father of Mrs. Sushma Swaraj was a prominent RSS member. She completed her BA in Sanskrit and Political Science from S. D. College, Ambala Cantonment. She completed her LL.B. from Punjab University and practiced as a Supreme Court lawyer for some time. Her political career began with the Akhil Bharatiya Vidyarthi Parishad, the student wing of the RSS and joined the BJP in the 1970s. She was elected six times to the Lok Sabha and three times as MLA.

She was the Minister for Information and Broadcasting during the 13-day Vajpayee Government in 1996. During this short tenure, she started live telecast of Lok Sabha debates. She also held the health ministry in the Atal Bihari Vajpayee government. She became a Member of Parliament in 1990. She won the Vidisha Lok Sabha constituency in Madhya Pradesh in 2014.

Sushma Swaraj had many firsts to her credit. At 25, she became the country’s youngest Cabinet minister in the Haryana government in 1977. She was the first woman CM of Delhi and the first woman spokesperson for a national political party in the country.

Humanitarian Gestures As Foreign Minister

Swaraj was especially known for lending a helping hand to Indians stuck overseas during her tenure as the External Affairs Minister. She was also known for her ‘digital diplomacy’, whereby she made extensive use of social media platforms to further diplomatic ties with other nations.

She will be especially remembered for her humanitarian gestures such as granting a medical visa to a Pakistani girl for heart surgery in 2017. She extended the medical visas of two other Pakistanis for liver surgeries in the same year.

In 2015, she helped hundreds of Indians stuck in Basra (Iran) based on a video she received on social media. In the same year, she came to the rescue of another Indian who lost his wallet and passport in Germany.

A Kashmiri medical student in the Philippines who sought her help with a damaged passport was also assured of help by her. The student’s profile mentioned that he hails from India-occupied Kashmir to which Sushma reminded him that there is no such place as India-occupied Kashmir.

These are just a few examples of her kindness. All these people reached out to her on social media, and she turned to their support without delay. Cutting across party lines, she had admirers even in the opposition and had cordial relations with many leaders from other political parties.

Factors that judges consider to set the bail amount

Published

on

Releasing a person after an arrest based on a written note declaring that the person would appear in court happens in some cases. Still, the most popular method is to release a person on paying the bail amount as per bail schedules for common crimes or the amount set by the court. Bail denial may also happen if the police feel that there is considerable risk in releasing the suspect.  Once the bail amount is known, the defendant or the arrested person must pay the amount in cash, which can often be a problem for most people because even a low bail amount might be too much for the suspect. Castle Columbus Bail Bonds helps to avoid the hassles of arranging cash; the company provides the bond by asking for only 10% of the bail amount.

A judge fixes the bail amount after holding a court hearing by considering several factors like a flight risk, community connections, income, and assets, etc. which can lead to refusal of bail.

Flight risk

Some defendants who are facing long-term confinement or sentences that can lead to death have higher flight risks than others. They have higher chances of fleeing as compared to those facing less serious charges.

Family obligations

If the court finds that the defendant is a responsible family man who looks after the well-being of family members and other dependents, it will likely consider that the person carries lesser risk and impose a lower bail amount.

Community connections

A person who has deep roots in society and has strong community connections has good chances of securing bail on the ground that the person would have more reasons to stay around instead of fleeing. If the person’s entire family resides in the area or he or she has a local business, the likelihood of the person appearing at the court is always higher.

Income and assets

Judges look at the income and assets of defendants to fix the bail amount that acts as a deterrent. A rich and wealthy person would not mind if served with a moderate bail amount that he or she can easily ignore, but on the other hand, the same amount might be a good deterrent for a person with low income.  The idea is to set the bail amount that remains higher than the resources accessible to the defendant.

Criminal history

A person with no previous criminal history can expect a much lower bail amount than those with some criminal history.  A person with criminal history and instances of failing to appear at the court belongs to the high-risk group and attracts a higher bail amount to cover the risk, which might even be so high that it becomes difficult to avail the bail.

Nature of crime

How serious is the crime is an essential factor in determining the bail amount.  Serious crimes involve a higher bail amount than a crime that is not that serious. For example, petty theft may attract a bail amount of $1,000, whereas a murder accused may have to pay thousands of dollars to secure bail.

Bail refusal can happen if the suspect poses public safety.

Lok Sabha Passes Triple Talaq Bill While The Opposition Stages Walkout

NEW DELHI: The bill for criminalizing instant ‘Triple Talaq’ was passed on Thursday, December 27, 2018, by the Lok Sabha. While passing it, the central government also rejected the contention that it was intended to target any specific community.

But surprisingly, the opposition, which was previously favouring the bill to be passed, staged a walkout which involved Congress, AIADMK, and RJD. The opposition made a walkout as the government rejected its demand to refer the bill to a joint select committee.

The Muslim Women (Protection of Rights on Marriage) Bill 2018 had been passed by the Lower House. 245 were in favour while 11 opposed the legislation.

The passed bill will now go to the Rajya Sabha for the final approval. It will supersede the previous bill passed in the Lok Sabha and pending in the Rajya Sabha.

The now passed bill was introduced in the Lok Sabha on December 17, to make the practice of triple talaq among Muslims a penal offense, and also to replace an ordinance issued previously in September.

After the bill was passed, law minister Ravi Shankar Prasad said that there should be no politics on the bill, and also that it wasn’t targeting any particular community.

He urged the lawmakers of various parties to speak in one voice to support the legislation. “Don’t weigh the bill on the scales of politics. The bill is about humanity and justice.”

He also regretted that obstructions were being created by the opposition parties, because of the ‘vote bank politics’.

Under the proposed law (after the bill will be approved in Rajya Sabha), giving instant triple talaq will be termed as illegal and void. And it will directly mean a jail term of three years for the husband.

Law Minister Ravi Shankar Prasad also said that the bill has made the offense compoundable, implying that the case can be withdrawn if the man and his estranged wife reach a compromise and that only the wife and her close relatives can file an FIR, thus ruling out the law’s misuse.

He also mentioned that as many as 477 cases of triple talaq have been reported since January 2017, and also highlighted a case where a man gave talaq to his wife on Whatsapp.

Actor Ashutosh Rana backs Naseeruddin Shah

Despite being criticized for expressing his grief over the present national scenario, showing his concern for his children regarding the situations of mob violence, veteran actor Naseeruddin Shah is also getting support now in the voice of another actor Ashutosh Rana, who’s backing him, for what he said.

Last week, in an interview, Shah had said that there were places in the country where the death of a cow is given more importance than that of a policeman. “There is complete impunity for those who take law into their own hands,” he told. He directly referred to the killing of Inspector Subodh Kumar Singh who was mobbed, in UP’s Bulandshahr, by violent people and killed eventually, over the killing of cows.

He also added that he feels anxious for his children because tomorrow if a mob surrounds them and asks, ‘Are you a Hindu or a Muslim?’ they will have no answer. And it worries him that he doesn’t see the situation improving anytime soon.

Coming forward in support of his words, actor Ashutosh Rana said, “Everyone should have a right to share their thoughts with their friends or other people without any fear. If our brothers or friends say something, we should not just listen to them but also think about it.”

Continuing further, he also said that, “If someone is speaking his mind and there is a debate, will it improve the country’s economic situation.”

Following his words and his thoughts in the interview, actor Naseeruddin Shah’s addressing at Ajmer was also cancelled on Friday evening, after the protests by the right-wing groups, including Bharatiya Janata Yuva Morcha.

The actor was immediately targeted by the right-wing groups who even asked him to leave the country. The Navnirman Sena, in fact, booked him a one-way ticket to Pakistan.

After the killing of Inspector Subodh Kumar Singh in the Bulandshahr mob violence, on December 3, the UP Police administration is being constantly criticized and slammed for taking no relevant action; in fact, the culprits also have not been arrested yet.

83 Ex-Bureaucrats Demand U.P. CM Yogi Adityanath’s Resignation

83 Ex-Bureaucrats Demand U.P. CM Yogi Adityanath’s Resignation

After the heinous crime of Bulandshahr, two weeks ago, in which the mob lynched the Police Inspector Subodh Kumar Singh, around 83 retired bureaucrats have now written an open letter, demanding the resignation of current Uttar Pradesh Chief Minister Yogi Adityanath. The letter signed includes the names of former secretaries like Shyam Saran, Sujatha Singh and Shiv Shankar Menon (former National Security Advisor), and other reputed names too.

They are straightly calling out for the resignation of the U.P. CM.

In the letter the bureaucrats said, “The mob violence in Bulandshahr, which led to the cold-blooded murder of a police officer marks the most dangerous turn yet in the direction taken by the politics of hate in recent times.”

“In UP, fundamental principles of governance, of constitutional ethics and of humane social conduct stand perverted. The Chief Minister acts as a high priest of the agenda of bigotry. Hooliganism and thuggery have been mainstreamed into governance. The murder of Subodh Kumar Singh was a deliberate attempt to display majoritarian muscle and send a message to the Muslim communities living in the region,” the letter by the bureaucrats told further.

It also said, “Our Prime Minister, who is so voluble in his election campaigns, maintains stony silence…Never before in recent history has the politics of hate, division and exclusion been so dominant and the poisonous ideology which informs it penetrated so deep into the body politic… Never before has hate been directed with such calculated intent against minority communities, hate which is nursed, aided and abetted by those in power…We demand the resignation of the Chief Minister.”

The bureaucrats also mentioned the point of ‘Rule of Law’, reminding the Chief Secretary, the Director General of Police, the Home Secretary and all other members of the higher civil services concerned, to implement it fearlessly in the state.

Shyam Saran, the former foreign secretary, also questioned the PM on the Bulandshahr incident that why he has kept himself silent so far, “Yes, I do not expect the PM to speak on each and every incident but is this like every other incident? Isn’t this instance somewhat different from your run of the wheel incidents that have happened in the past – which by the way also should be taken notice of.”
