ALBANY, N.Y. (NEWS10) — New York State is facing multiple lawsuits over its vaccine mandate for health care workers. And it comes at a time where there are already staffing shortages in the industry.

“I believe that it’s critically important for our health care workers to be as healthy as they can before they attend to the health of others,” Governor Hochul said Thursday.

Monday is the state’s deadline for health care workers to receive their first dose of the COVID-19 vaccine. While the overwhelming majority of these workers are vaccinated, the mandate has received some legal challenges. 

One group of medical workers has filed a lawsuit for a religious exemption to the rule. A judge has put a temporary restraining order on the enforcement of the mandate until October 12th, but only for those claiming a religious exemption.

Meanwhile a separate lawsuit has been filed by some members of the New York State Correctional Officers and Police Benevolent Association. They are state hospital security officers who say the mandate violates their constitutional rights. 

Michael Balboni with the Greater New York Health Care Facilities Association says while every health care agency benefits from all residents and staff being vaccinated, the mandate could further exacerbate staffing shortages. He’s calling on officials to come up with an emergency staffing plan. “The deadline brings into sharp focus how prepared the health care industry is for thus type of potential on staffing,” Balboni said. Hochul has said she’s prepared to announce a “series of initiatives” to prepare for Monday if need be. 

The Civil Service Employees Association is also challenging the state and won a court order to temporarily halt the mandate for non-judicial court system workers.

ARLINGTON — Gleyber Torres was knocked out of the Yankees’ roster late on Monday as they began a four-game series over the next three days. Torres was in the original lineup playing second and third. Aaron Boone said he just didn’t feel well under the weather.

With the Yankees clinched the No. 2 seed in the American League playoffs and already winning the AL East, now is the time to take advantage of these days to improve. The Yankees manager will try to get some players off days. It started Monday night with Anthony Rizzo, Harrison Bader and Jose Trevino on leave.

But, Aaron Judge was back for his 53rd straight start and still chasing history. Judge is tied with Roger Maris for the AL and Yankees single-season home run record of 61.

And it could stay there until it hits No. 62, Boone said.

“A lot depends on that. So I don’t have a plan in place yet. He’s in there today. And then we just go, him and I will get together after the game and have those conversations and decide what’s the best course to take,” Boone said.

The judge still has four games to try to set a new mark. He’s hitting .233 with a home run, 18 walks and 14 strikeouts since hitting his 60th homer on Sept. 20. . He’s slashing .398/.562/.847 with 20 extra hits, 21 RBIs, 30 runs and 37 walks in that span.

The Yankees have a five-day break that comes with the bye to the first round of the playoffs, which Boone takes into consideration when playing Judge.

“Yeah, so I’m not worried about the physical part. Of course I would love for him to do that and then really be able to get him out of there, but for now for the next few days they’ll just be him and I’ll get together after the game.”

Boone said there was a chance Judge could play both games of Tuesday’s doubleheader if he hadn’t hit 62 homers.

Ron Marinaccio had an MRI, CT scan and right shin exam Monday morning and did not join the Texas team until after the game.

“It’s just reading it and what it means,” Boone said. “He’s not here. So we’ll see what we have here. Hopefully we’ll know something in the next few hours.

Marinaccio stepped up, making 40 appearances and hitting a 2.05 ERA in his rookie season.

LEMAHIEU FEELS READY

DJ LeMahieu has only played twice since missing 21 games with inflammation in his right big toe and second toe, but the infield veteran believes he’ll be able to play the playoffs effectively playoffs.

“It’s a little better than a few weeks ago. But I don’t think it’s going to go away,” LeMahieu said. “So I just have to deal with it.”

LeMahieu has these four games, which he would like to play, to recover his time. He will also have the five-day break between the end of the regular series and the Division series.

Paolo Banchero has experienced many firsts since the Orlando Magic selected him with the No. 1 pick in June’s NBA draft.

His first summer-league game, media day and practice during training camp have been notable moments.

Now he can add his preseason NBA debut to the list — Monday night’s exhibition at the Memphis Grizzlies.

“Obviously, it’s something I’ve been waiting for for a while,” Banchero said ahead of Monday’s game. “Excited to get on an NBA court in an NBA arena and just play a game. I’ve been waiting for a long time. Summer league was a step, but it wasn’t the real thing. So, happy to be here.”

In addition to the already-known absences of Markelle Fultz (left big toe), Gary Harris (left knee) and Jonathan Isaac (left knee), Admiral Schofield (sore left knee) and Franz Wagner (rest after EuroBasket play) were ruled out for Monday.

“A lot of that is monitoring his workload,” coach Jamahl Mosley said of Wagner. “He averaged about 29 minutes over there and just getting acclimated back to what we’re doing here. Making sure we’re staying on top of it.”

Banchero, Cole Anthony, Jalen Suggs, Mo Bamba and Wendell Carter Jr. started against Memphis.

Monday’s game was the first of five preseason games the Magic will play before kicking off the regular season against the Pistons on Oct. 19 in Detroit.

Orlando will play the Spurs in San Antonio Thursday in its next preseason game before matching up against the Mavericks in Dallas Friday.

The Magic wrap up their preseason slate with home games vs. the Grizzlies (Oct. 11) and Cleveland Cavaliers (Oct. 14).

For second-year coach Mosley, preseason is about experimenting with different lineups and combinations while also continuing to lay the foundation that was started last season and seeing where players’ understandings of the team’s concepts are.

“It’s our ability to see if they’re grasping the things we’ve asked from them from last year,” Mosley said. “The level of consistency we’re asking them to play with; how they do things from what we learned last year. That’s the idea of leveling up — making sure they understand what we put in and how fast they can pick it up.”

Radio announcer

Ahead of Monday’s game, the Magic officially named Jake Chapman as Orlando’s radio play-by-play announcer.

Chapman began his career with the Magic in 2006 as a radio intern before serving as the team’s radio producer from 2009-14.

He’s entering his 10th season with the Magic after stints as the pregame and postgame host and executive producer of the Detroit Pistons Radio Network and a producer and host for 92.3 The Fan and the Cleveland Browns Radio Network.

Chapman, who returned to the Magic in 2019, also serves as the team’s radio producer, pregame and postgame radio host for the Magic Radio Network.

Naver, the South Korean search giant, today announced plans to acquire second-hand clothing marketplace Poshmark for $1.2 billion in cash. The deal values ​​Poshmark’s publicly traded shares at $17.90 – a 15% premium to today’s closing price – and the companies expect it to close by the first quarter of 2023, subject to Poshmark shareholder approval and “the satisfaction of certain other customary closing conditions”.

If the transaction is successful, Poshmark will become a stand-alone subsidiary of Naver led by CEO Manish Chandra and Poshmark’s current management team. It will also continue to operate under its existing brand and maintain its staff, user base, and headquarters in Redwood City, CA.

In a press release, Naver and Poshmark lay out several arguments as to why the deal makes sense for both parties. By acquiring Poshmark, Naver hopes to capitalize on the service’s growing social shopping platform, where users buy and sell clothes online, with its “technological prowess”. As for Poshmark, it is supposed to benefit from Naver’s image recognition and smart goal search technologies, which Naver says will enable the shopping platform to offer new search, recommendation and shopping that allow users to find clothes by searching colors, designs and materials and identifying where to find products by scanning clothes using their phone’s camera.

Naver also touts its robust ad serving and payments infrastructure, saying Poshmark will be able to leverage it to better analyze sales statistics and serve international customers. The long-term plan is to – with the support of Naver – expand Poshmark’s business into other developed markets in Asia and elsewhere where Naver has significant business holdings, in part by integrating some of the live shopping services from Naver to the Poshmark platform. At the same time, Poshmark will leverage Naver’s U.S. footprint, which includes digital comics portal Webtoon Entertainment and online storytelling platform Wattpad.

Naver optimistically predicts the acquisition could boost Poshmark’s annual revenue “beyond” 20% and save the company $30 million in annual run rates within two years.

Poshmark’s exit comes more than a decade after it was founded in 2011. Prior to its Nasdaq listing at a valuation of over $3 billion, Poshmark raised over $160 million in venture capital from venture capital firms such as Temasek, Menlo Ventures, GGV Capital and Mayfield.

Poshmark claims to have over 80 million registered users.

However, it appears the pastor did a terrible job or made Nia realize what an a** her ex-partner is. A man who puts his job on the line for “2 minutes” pleasure is surely not worth it and Nia grasped just that.

Besides, what will a 51-year-old successful actress do with a cheating partner? Nia allegedly left together with their 12-year-old son. And Udoka is now left to his fate.

In addition to his family, Ime Udoka is likely to lose his job as the head coach of Boston Celtic – over a violation of organizational guidelines as the affair is allegedly not entirely consensual. An affair to die for huh?

With closer Félix Bautista still dealing with left knee discomfort, Orioles manager Brandon Hyde said Bautista will be shut down for the final three games of the season.

With his high-velocity fastball and captivating entry that included flashing lights and Omar’s Whistle at Camden Yards, Bautista became one of the top-level closers this year. Hyde said there’s no concern about the knee discomfort leading to anything more serious after he landed oddly in the eighth inning of Friday’s game against the New York Yankees.

Bautista was officially placed on the 15-day injured list Monday, with right-hander Yennier Cano recalled to replace him. The Orioles finish their season on Wednesday against the Toronto Blue Jays.

When the Orioles traded closer Jorge López to the Minnesota Twins at the trade deadline in August, Bautista, 27, was the next in line to assume those save situations. He took the role with aplomb, and he finished with 15 saves with just two blown saves.

His splitter took center stage as one of the most dominant pitches in baseball, with a run value of -6, according to Statcast — no other reliever had a splitter with a better run value, and Bautista ranked fifth overall. Bautista’s four-seam fastball, which topped 100 mph on 203 occasions, was the best on the Orioles with a -14 run value. (Run value measures a pitch’s impact on how many runs an opponent scores based on the situations it’s used, with lower being better for pitchers.)

Bautista finished with a 2.19 ERA with 88 strikeouts in 65 2/3 innings in 65 games. Bautista also dealt with arm fatigue near the end of the season after he completed a six-out save last month.

“Just so happy with the season he’s had and him going forward,” Hyde said. “What a great story. Great story for us, great story for him.”

Before the season began, Bautista, who didn’t reach the Triple-A level until late last season, was somewhat of a wild card. He began his career with the Miami Marlins but was released in 2015. He joined Baltimore the next year, navigating his way through rookie ball in the Dominican Summer League for his first two seasons with the organization.

He reached affiliate play in 2019, then took off in 2021 by rising three levels by the season’s end. While he averaged 5.8 walks per nine innings last year, he increased his strike-throwing capabilities entering spring training and broke camp with the team. He quickly earned a late-inning role, then took over as a closer to finish the season with a 0.93 WHIP.

“Loved watching him pitch,” Hyde said, “and looking forward to him next year.”

The start of recovery

Infielder Ramón Urías said his right knee sprain will take eight to 12 weeks to heal, with the first month requiring rest before he begins rehab.

Urías suffered the injury last week against the Boston Red Sox. He first felt the pain sliding into home plate Wednesday, but he figured he could play through it. Later in the game, as he ran from second to third, Urías felt “a pop and some pain,” but the injury won’t require surgery.
