Caretaker Of At-Risk Adult In Denver Faces Grievous Bodily Negligence Charge

A Denver man is facing a criminal charge of negligence causing grievous bodily harm for allegedly failing to provide for an intellectually and developmentally disabled man who was in his host’s home care.

Michael Hill, 40, faces the felony charge in an investigation that began in December 2019, according to a press release from the district attorney’s office.

The criminal investigation unfolded when Colorado Adult Protective Services contacted Denver police about the victim’s concerns, the statement said. A detective came to the house for a ‘wellness check’ and ‘found the victim naked and covered in feces’.

The victim was taken to a local hospital where staff found him severely malnourished and dehydrated, the statement said. Investigators suspect he did not receive prescribed medication properly while in Hill’s custody.

CHICAGO — The Major League Baseball Umpires Association released a concise statement on Wednesday regarding the criticism umpires are receiving as a result of the home plate collision rule.

The rule has been a topic around the game after several video reviews recently resulted in overturned calls to home plate, including during Tuesday’s game between the Cleveland Guardians and the Detroit Tigers.

The statement, obtained by ESPN on Wednesday, reads, “It is the catcher’s responsibility not to position themselves in such a way as to block home plate without the ball.

“This rule change was enacted after Buster Posey was involved in a collision at home plate and suffered a serious leg injury. The Players Association and Owners have decided to protect their major assets (players) and have adopted the home plate collision rule that players are now complaining about.”

The umpires argue they’re just following the rule that’s on the books, the one the league sent a memo to teams on earlier this month. The memo was accompanied by illustrations and reminders of how and where a receiver can and cannot set up when receiving the ball from a defender.

“It’s simple: don’t block home plate without possession of the baseball or change the rule,” the umpire’s statement read.

The latest on-court controversy came early in the first inning Tuesday at Cleveland. Guardians receiver Austin Hedges caught a pitch from shortstop Tyler Freeman as Javier Baez slid home. Baez was called but the video review canceled the call, saying “the catcher didn’t give the runner a lane.” The Tigers scored three runs in the inning, beating the first-place Guardians, 4-3.

“First of all it cost the game,” Hedges said after the loss. “It’s a game that’s been called a few times recently and never really been called before. … There are home games that beat the runners and for 150 years you’re out. And now we let’s call a type of rule that’s really tricky to define.”

The video review has overturned eight home calls this season, the most since 2014 freshman teams could contest the call. The most recent have prompted teams to seek clarification from the league, which it has provided.

“Recently, we have seen seekers take advantage of runners they expect to slide while moving down the running lane without possession of the ball, in violation of Rule 6.01(i)(2),” reads the league memo. “Such conduct only invites runners to collide with receivers, causing potential injury to players in a way the rule was designed to prevent. Receivers cannot block runners’ path unless they are in possession of the ball or playing the ball.”

Referees say they feel caught in the middle, saying it’s not their job to call the blocking rule live, but to leave the video review to New York – which is handled by the current referees – s take care of it.

Their statement then extended beyond the home plate collision rule.

“It is also inaccurate to say that umpires in Major League Baseball are not held accountable. It is often said of our profession that ‘umpires are supposed to be perfect from the start and improve from there.’

“Like players, our mistakes are subject to intense public scrutiny and we are also held accountable by our employer in performance reviews. Although we don’t always know in real time if our calls are correct, we scrutinize them closely after the game and try to learn from all the mistakes.”

A Florida prosecutor has sued Governor Ron DeSantis (R) seeking reinstatement after he was removed from office for pledging not to pursue cases stemming from the 15-week abortion ban in Florida and potential bans on gender-affirming care.

Hillsborough County State’s Attorney Andrew Warren (D) argued his Aug. 4 suspension was unlawful on First Amendment grounds and called his removal a “retaliation” by DeSantis against a critic and political rival, according to a federal complaint filed Wednesday in the Northern District of Florida.

In a video message, Warren said that in addition to violating his free speech rights, DeSantis broke Florida law.

“He violated the Constitution of Florida by removing me from office without any legal justification, rejecting the results of a fair and free election,” Warren said.

DeSantis’ office dismissed Warren’s federal complaint as “without merit.”

“It’s no surprise that Warren, who was suspended for refusing to follow the law, is filing a lawsuit without legal basis to challenge his suspension. We look forward to responding in court,” a DeSantis spokesperson said in a statement.

Warren has been in office since 2016 and won re-election in 2020 with over 53% of the vote.

DeSantis suspending Warren and replacing him with someone he chooses sets an ominous tone for democracy in Florida, Louis Virelli, a law professor at Stetson University College of Law, told The Washington Post.

“One small step from here is if, as governor, I don’t think a state attorney is tough enough for a particular crime, I’m going to replace you with someone I prefer,” Virelli said. “That takes precedence over voter choice.”

Virelli said the complaint is one of the few options available to Warren if he wants to keep his job.

Part of Warren’s argument in the complaint is that the Florida Constitution limits dismissal to genuine incompetence or inability to do the job and breach of legal duty.

“Warren is being punished for what he said and not for what he did,” Virelli said.

Shortly after Warren was suspended, her office’s communications manager was told she had to resign and be paid throughout the month – or be fired on the spot.

Melanie Snow-Waxler, who began her role with the state’s attorney’s office in May, was fired Aug. 12.

“This unlawful termination is part of a troubling pattern of retaliation,” his attorney, Ryan Barack, said in a statement this week.

DeSantis and Warren are ideological opposites who have publicly argued over topics including abortion, covid restrictions, criminal justice and transgender rights.

In June, the day the Dobbs vs. Jackson decision was made, effectively ending the federal right to abortion access, Warren joined dozens of prosecutors across the country in signing a pledge that they “would refrain from using resources limitations of the criminal justice system to criminalize personal medical decisions”.

In 2021, Warren signed a similar joint statement with other elected prosecutors saying health care decisions should be a matter of “private discretion” and said they would not use their office to “promote the criminalization of gender-affirming or transgender health care”.

The DeSantis administration pursued aggressive policies to increasingly restrict medical treatments like puberty blockers and hormone therapy; just last week, the state banned people from using Medicare coverage to help pay for gender-affirming care.

Since Warren’s suspension, he and DeSantis have been at odds over the nature of the suspension. While Warren called his suspension “temporary” in his filing, DeSantis’ office said Warren was no longer the Hillsborough County 13th Judicial Circuit prosecutor after the governor nominated Susan Lopez, a Republican judge who supported Warren’s opponent in 2016.

Last Man Jailed For 1976 Chowchilla Bus Abduction Will Be Released, Officials Confirm

CHOWCHILLA, Calif. (KFSN) — It was a crime that captured the nation.

A Chowchilla bus with 26 children and a driver on board, ambushed by three armed kidnappers who buried them alive.

46 years later, two of the three convicted kidnappers have been released.

And now, the day many have dreaded for decades – the third co-conspirator has also been granted parole.

On July 15, 1976, as a bus driver and 26 children were traveling on the bus, a van suddenly appeared and blocked the road.

Frederick Newhall Woods IV, 24, and brothers James Schoenfeld, 24, and Richard Schoenfeld, 22, held them captive in a box truck at a rock quarry north near Livermore.

The men planned to demand a ransom for their return, but the children and their driver escaped hours later.

The three brothers were arrested and sentenced to life imprisonment.

In June 2012, at age 57, Richard Schoenfeld was granted parole and released from prison. Three years later, his older brother James was released.

On Wednesday, officials with the California Department of Corrections and Rehabilitation said Fred Woods had been granted parole.

Prosecutors considered Woods to be the mastermind of the crime.

ABC30 spoke to Larry Park, who was only 7 at the time of the abduction. He admits to still being traumatized by the incident and says he struggled with addiction for most of his life.

“Hardly a day goes by that I don’t think about this incident,” he said.

The trauma led to schizophrenia and addiction for Park, but now, decades later, he’s chosen forgiveness.

“It is possible to forgive and it is possible to find peace,” he says.

Woods was granted parole after appearing before a parole board 17 times.

Madera County District Attorney Sally Moreno said she fought to keep Woods behind bars.

“Has he demonstrated that he has been rehabilitated? And he hasn’t. As recently as 2019, he was disciplined for running businesses out of jail or prison,” Moreno said.

But after his parole was reviewed this week, the decision became official. Woods will soon be released from California Men’s Colony in San Luis Obispo.

“The kidnapping was about the money. When they arrested him, he was busy selling the rights to the movie to a Hollywood agent. It was always about the money. And those kids got into it. between him and the money and everything he had to do to get the money he would have made to those kids, including burying them alive,” Moreno says.

Some of those who defended him at his final parole hearing were unlikely supporters. Larry Park was among them.

“You come to a point where you realize that this hatred and resentment and bitterness that I’ve held all my life for these three men – Fred, Richard and James – I just want them to find some peace and comfort and have a good life,” Park says.

DA Moreno and other kidnapping survivors who participated in the parole hearing were convinced that Woods was not ready for release.

“Anything he has to do to make more money, he’ll do it. Anyone who gets in his way, you better watch out,” Moreno said.
