In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement that are reported to us in compliance with the guidelines provided below.

Reporting Claims of Copyright Infringement

If you believe that any content on RecentlyHeard.com infringes upon your copyright, you or your authorized agent may submit a DMCA Takedown Notice to us. The notice must include the following information:

Submitting a DMCA Notice

Upon receipt of a valid DMCA notice, we will investigate the claim and remove or disable access to the allegedly infringing material. We will also notify the user who posted the material of the takedown request.

Counter-Notification

If you believe that the content removed under a DMCA notice was taken down by mistake or misidentification, you may file a counter-notification with us. The counter-notification must include the following:

  1. Identification of the material that has been removed or disabled and the location where the material appeared before it was removed.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district or, if you are outside the United States, to the jurisdiction of any judicial district where the service provider is located, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  4. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the party who submitted the original DMCA takedown notice. If the original party does not file a legal action within 10 business days, we may restore the content that was removed.

Repeat Infringers

RecentlyHeard.com reserves the right to terminate the accounts or block the access of users who are repeat infringers of copyright.

Misrepresentation

Please note that under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages (including costs and attorneys’ fees). Similarly, any person who knowingly misrepresents that material was removed or disabled by mistake or misidentification may also face legal consequences.
